Federal Status
Cannabis remains a Schedule I controlled substance under the federal Controlled Substances Act — classified alongside heroin and above cocaine (Schedule II). This creates a fundamental conflict with state laws where cannabis is legal.
In 2024, the DEA proposed rescheduling cannabis to Schedule III, which would acknowledge its accepted medical use and lower abuse potential. As of May 2026, the final rule is under review following a 43,000+ comment public period.
Rescheduling to Schedule III would not federally legalize cannabis but would remove the 280E tax burden on cannabis businesses and open pathways for pharmaceutical research.
Key Federal Implications
Banking Access
Most cannabis businesses cannot access traditional banking due to federal prohibition. The SAFER Banking Act has passed the Senate but not the House.
Interstate Commerce
Cannabis cannot legally cross state lines, even between two legal states. Each state market must be self-contained.
Federal Employment
Federal employees and contractors are subject to federal law. Cannabis use can result in termination regardless of state law.
Cole Memo Precedent
DOJ policy (Cole Memo, 2013) deprioritized federal enforcement in states with robust regulatory frameworks. This policy remains in effect.
